Please read these Terms & Conditions ("Terms") carefully before using the BookDesk mobile application or booking portal (collectively, the "Service") operated by BookDesk ("we", "our", or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
BookDesk is a scheduling platform that enables professionals ("Advisors") to manage their appointment calendars and allows their clients ("Clients") to book appointments through a public booking portal. The Service includes appointment creation, reminders, SMS notifications, and Google Calendar synchronization.
You must be at least 18 years old to create an Advisor account. By using the Service you represent that you meet this requirement. The public booking portal may be used by Clients of any age with the consent of a parent or guardian if under 18.
To access the full Service as an Advisor, you must create an account with a valid email address and password. You are responsible for:
We reserve the right to suspend or terminate accounts that violate these Terms.
Advisors who use the Service to collect bookings from their Clients are responsible for:
BookDesk acts as a data processor on behalf of Advisors with respect to Client data entered through the booking portal.
By providing a phone number in the booking portal, Clients consent to receive SMS messages (appointment confirmations and reminders) sent by BookDesk on behalf of the Advisor. The following conditions apply:

The Service, including its design, software, and content, is owned by BookDesk and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
You retain ownership of any content you upload (e.g., profile photos, client notes). By uploading content you grant us a limited license to store and display it solely to provide the Service.
The Service integrates with third-party providers including Google Calendar, Twilio (SMS/WhatsApp), Supabase, and Expo. Your use of these integrations is subject to each provider's own terms of service. We are not responsible for the availability or actions of third-party services.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
We are not responsible for any missed appointments, scheduling errors, or damages resulting from your use of the Service.
To the maximum extent permitted by applicable law, BookDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at the email below. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. We will notify you of significant changes via the app or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the jurisdiction in which BookDesk operates, without regard to conflict-of-law principles.

Lee detenidamente estos Términos y Condiciones ("Términos") antes de utilizar la aplicación móvil o el portal de citas de BookDesk (en conjunto, el "Servicio") operado por BookDesk ("nosotros").
Al acceder o utilizar el Servicio, aceptas quedar vinculado por estos Términos. Si no estás de acuerdo, no uses el Servicio.
BookDesk es una plataforma de agendamiento que permite a los profesionales ("Asesores") gestionar su calendario de citas y a sus clientes ("Clientes") reservar citas a través de un portal público. El Servicio incluye creación de citas, recordatorios, notificaciones por SMS y sincronización con Google Calendar.
Debes tener al menos 18 años para crear una cuenta de Asesor. Al usar el Servicio declaras cumplir con este requisito. El portal de reservas puede ser usado por Clientes de cualquier edad con el consentimiento de un padre o tutor en caso de ser menor de 18 años.
Para acceder al Servicio completo como Asesor, debes crear una cuenta con un correo electrónico y contraseña válidos. Eres responsable de:
Nos reservamos el derecho de suspender o cancelar cuentas que violen estos Términos.
Los Asesores que usen el Servicio para recibir reservas de sus Clientes son responsables de:
BookDesk actúa como encargado del tratamiento de datos en nombre de los Asesores respecto a los datos de Clientes ingresados a través del portal de reservas.
Al proporcionar un número de teléfono en el portal de reservas, los Clientes consienten recibir mensajes SMS (confirmaciones y recordatorios de citas) enviados por BookDesk en nombre del Asesor. Se aplican las siguientes condiciones:
Aceptas no usar el Servicio para:
El Servicio, incluyendo su diseño, software y contenido, es propiedad de BookDesk y está protegido por las leyes de propiedad intelectual aplicables. No puedes copiar, modificar, distribuir ni crear obras derivadas sin nuestro consentimiento previo por escrito.
Conservas la propiedad del contenido que subas (por ejemplo, fotos de perfil, notas de clientes). Al subir contenido nos otorgas una licencia limitada para almacenarlo y mostrarlo únicamente para prestar el Servicio.
El Servicio se integra con proveedores externos como Google Calendar, Twilio (SMS/WhatsApp), Supabase y Expo. Tu uso de estas integraciones está sujeto a los propios términos de servicio de cada proveedor. No somos responsables de la disponibilidad ni las acciones de los servicios de terceros.
El Servicio se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas. No garantizamos que el Servicio sea ininterrumpido, libre de errores o libre de virus u otros componentes dañinos.
No somos responsables de citas perdidas, errores de programación ni daños derivados del uso del Servicio.
En la máxima medida permitida por la ley aplicable, BookDesk no será responsable de daños indirectos, incidentales, especiales, consecuentes o punitivos derivados del uso o imposibilidad de uso del Servicio, incluso si hemos sido advertidos de la posibilidad de dichos daños.
Podemos suspender o cancelar tu acceso al Servicio en cualquier momento, con o sin causa y con o sin previo aviso. Puedes cancelar tu cuenta en cualquier momento escribiéndonos al correo indicado al final. Tras la cancelación, tu derecho a usar el Servicio cesa de inmediato.
Podemos actualizar estos Términos ocasionalmente. Te notificaremos de cambios significativos a través de la app o por correo. El uso continuo del Servicio después de los cambios implica la aceptación de los Términos actualizados.
Estos Términos se rigen por las leyes de la jurisdicción en la que opera BookDesk, sin considerar principios de conflicto de leyes.
